The National Committee on the Implementation of International Humanitarian Law (IHL) in Kenya was established under the International Humanitarian Law (Implementation) Act, 2012. It began operations in 2013 to ensure the country’s compliance with international humanitarian law, including the Geneva Conventions and other treaties. The committee’s mandate includes advising the government, coordinating the implementation of IHL, monitoring its application, and promoting awareness. It also ensures that Kenya’s legal frameworks align with IHL principles, providing a platform for dialogue and cooperation with international bodies in
upholding humanitarian law.
Functions
- Advisory Role: The Committee advises the government on the interpretation and application of international humanitarian law, ensuring that Kenya adheres to its international obligations under IHL treaties and conventions such as the Geneva Conventions.
- Monitoring Compliance: It monitors the application of IHL within Kenya, ensuring that national policies, legislation, and practices align with international humanitarian standards.
- Coordination: The Committee coordinates the work of various government agencies, institutions, and NGOs involved in the implementation and enforcement of IHL, ensuring a unified approach.
- Legal Reforms: It proposes and advocates for legislative and policy reforms aimed at strengthening Kenya’s legal framework to fully comply with IHL and international human rights law.
- Promote Awareness: The Committee conducts public awareness campaigns, educational programs, and workshops to enhance understanding of IHL among the general population, government officials, and institutions.
- Capacity Building: It organizes training programs for various stakeholders, including military personnel, law enforcement agencies, civil society, and legal professionals, to enhance their understanding and application of IHL.
- International Cooperation: The Committee collaborates with international bodies, such as the International Committee of the Red Cross (ICRC) and other states, to ensure Kenya’s participation in global IHL frameworks and initiatives.
- Advocacy for IHL: It advocates for the promotion and respect of IHL in conflict situations, engaging both national and international actors to protect victims of armed conflict and ensure the humane treatment of all individuals.
- Prepare Reports: The Committee prepares reports on Kenya’s implementation of IHL, which are submitted to international bodies such as the United Nations and the International Committee of the Red Cross (ICRC), as part of Kenya’s reporting obligations under international law.
- Disseminate Information: It disseminates IHL-related materials, including manuals, guidelines, and publications, to enhance the knowledge and application of IHL among relevant stakeholders and the general public.
